All agreements between the buyer and the seller are governed by these terms and conditions, unless expressly stipulated otherwise. Any deviation from this rule must be expressly agreed with us in writing. The application of all the general terms used by the buyer is excluded.

Characteristics of the goods and services offered

The products and services offered are those in the catalogue published on the omega.be website.

These products and services are available within the limits of available stocks. Stocks are kept up to date on a daily basis. The number of products ordered may be greater than the number of products in stock. In this case you will be notified by email, and we will tell you the date of availability of your product.

The photographs in the catalogue are as faithful as possible but cannot ensure a perfect similarity with the proposed product, especially with regard to the colours.

 

Order offers, orders and confirmations

Offers of any kind made by the seller are only valid after express confirmation in writing by the seller.
The buyer, who wishes to purchase a product or service, must:

  • Fill out the identification sheet on which it will indicate all the requested contact information, as well as any information necessary for delivery. The password that allows access to your customer account is strictly personal. Confirmation will be worth signing and accepting the transactions performed. Omega Music will provide confirmation of the registered order via email. Omega Music cannot be questioned and held responsible for the consequences of any event beyond its control, including cases of force majeure, which would tend to delay or prevent the online ordering. Some orders may be subject to additional requests to the customer. In this case, the customer is notified by email or phone of the supporting documents to be sent in order to obtain the final validation of his order.

Omega Music reserves the right to cancel the order in the event of non-receipt of supporting documents or receipt of documents deemed non-compliant. The customer's order may be
cancelled by Omega Music for any reason, especially if there is a lack of information necessary for delivery. The customer will be informed by Omega Music.

 

Price

All our prices are always VAT included, excluding packaging, assembly and installation costs as well as the start-up of the products. All prices and incidental charges are those that are in effect at the time of delivery.

In the event that, between the closing date of the sale agreement and the delivery date, prices have increased, for whatever reason, the seller has the right to recover this price increase from the buyer. If the price exceeds the agreed price of 10%, the buyer will have the right to terminate the contract

 

Payment

The payment of purchases made on the www.omega.be website is made on order.

Credit card payments are made through Ogone's secure system, which uses the Secure Socket Layer (SSL) protocol so that the information transmitted is encrypted by software and no third party can see it.

 

Delivery

The customer undertakes to transmit, during the order, all the information necessary for the delivery in order to guarantee the good end. In particular, the customer must provide a telephone number to which the carrier can reach him during the day. The customer agrees, for himself or for the recipient of the order, to take delivery of the goods to the address he indicated during the order.

At the time of delivery, the customer or the recipient of the products must be able, if requested, to prove his identity. The customer agrees, after opening and verifying the contents of the parcel or parcels in the presence of the carrier, to sign the delivery receipt presented by the delivery driver. In case of damage, non-compliant delivery, unpacking failure, or defective products, the customer can refer to the "Return Management" page. Delivery does not include the commissioning of the devices.

The shipping time is defined as off weekends and holidays. The order will only be processed upon receipt of payment. Availability and shipping times start from the date of registration and validation of the means of payment.

There is usually an additional delay for shipments outside Belgium. In the event of a foreseeable extension of the shipping time, Omega Music undertakes to inform the customer as soon as possible and by any means so that the customer can then choose to maintain or
cancel his order altogether or partially. The delivery time cannot in any way result in the payment of damages for the benefit of the customer or the customer's service providers.

 

Withdrawal and right of return

Buyers, non-professional individuals, benefit from a withdrawal period of 14 days from the delivery of their order to return the product to the seller for exchange or refund without penalty.

All items can be exchanged or refunded within legal deadlines, except products customized by Omega Music according to the customer's wishes, off-assortment products (specially ordered), software returns, CDs, DVDs whose sealed packaging has been opened, books and items that cannot be returned for a hygiene issue such as headphones. , headsets and helmets.

The return costs are the responsibility of the customer. The customer must complete the downloadable return form directly on the website and contact customer service before sending.

Returned products must be in their original packaging, in perfect condition, accompanied by all possible accessories and instructions as well as the return form, duly completed. Incomplete, damaged, damaged, or used returned items will not be recoverable, and will be returned at the customer's expense.

Product refunds will be made within 7 days of receiving products from Omega Music. The refund will be made exclusively by bank transfer.

 

Transportation/Loss

In the event of a confirmed declaration of loss of the package by our carrier, depending on the nature of the product, the stocks available and according to the customer's wishes, we will propose to re-export the product initially ordered or an exchange product with equivalent characteristics.

In the event of a defect at the reception, the client will carry a marked reserve on the material sheet, have the delivery driver co-sign and keep a copy of the document. If the product is damaged, the customer must refuse the package and note a reservation on the delivery slip. These reservations must be very specific. The word "subject to unpacking" is not a characterized reserve and has NO LEGAL VALEUR. It is therefore essential to describe precisely the condition of the packaging and/or the product, and to accurately indicate the damage (e.g. breakage noises, open parcels, damaged packaging, torn, pressed on the bottom right corner, striped product, pressed, on the left flank, parcel refused because opened or damaged during delivery...).

In the event of the transport provider's inability to deliver (e.g., failure to make a delivery appointment, non-removal of parcels after notice of passage or incorrect address), the customer will have to pay the delivery fee corresponding to the re-shipment of his order.

 

Contractual guarantee

This guarantee offered by Omega Music does not cover:

  • replacing consumables (batteries, light bulbs, fuses, ropes)

  • abnormal or non-compliant use of the products. In this regard, we invite you to carefully consult the instructions provided with the products
  • damage caused by the intervention of an unlicensed repairer by Omega Music
  • damage resulting from an external cause of the aircraft (e.g., accident, shock, current fluctuation, temperature and/or hydrometric differences)

Items will first be sent or deposited at Omega Music. Acceptance of a repair or replacement depends on the manufacturer's assessment.

 

Responsibility

The seller, in the process of online sales, is bound only by an obligation of means; it cannot be liable for damage resulting from the use of the Internet such as data loss, intrusion, viruses, service disruption, or other unintentional problems.

Omega Music cannot be held responsible for the breach of the contract concluded, due to the occurrence of a force majeure event and in particular in the event of a total or partial strike of postal services, carriers, and disasters caused by floods or fires. For products purchased to meet business needs, Omega Music will not incur any liability for any indirect damages as a result of this, loss of operations, loss of profit, damage or costs, which may occur.

The choice and purchase of a product or service is the sole responsibility of the customer. The total or partial impossibility of using the products in particular because of the incompatibility of the equipment may not give rise to any compensation, reimbursement or questioning of Omega Music's liability, except in the case of a proven hidden defect, non-compliance, defect or exercise of the right of withdrawal.

 

Intellectual property

All elements of Omega Music's website are and remain the exclusive intellectual property of Omega Music. Conditions for VAT-free payment

If you, as a company, provide Omega Music with a valid intra-EU VAT number issued by the European Union country in which your company is based, Omega Music will not charge you VAT on the amount of your order. We check your VAT and identity number and charge on behalf of the company linked to this VAT number.

You must be aware and accept the following conditions:

  • You declare and guarantee that the intra-EU VAT number you provide to Omega Music corresponds to your business and that this company is based in a European Union country;
  • You declare and guarantee that all transactions made on your account will be made by your company with the intra-community VAT number you provided to Omega Music;

Omega Music will cancel the order in the event that the VAT number provided is invalid or if the supporting documents for the exemption are not provided

Outside the Shengen area, the purchase or purchases will be made without VAT. You will be responsible for customs or various taxes.

 

Dispute resolution

These online sales conditions are subject to Belgian law. In the event of a challenge, only the Mons court has jurisdiction.
